Complaints and Claims Procedure of CollectorPick s. r. o.
This Complaints and Claims Procedure governs the procedure for exercising rights arising from liability for defects in goods purchased through the CollectorPick online store at collectorpick.com, in accordance with Act No. 40/1964 Coll., the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, and other generally binding legal regulations of the Slovak Republic.

Buyer:
A natural person or legal entity who orders goods through the CollectorPick online store at collectorpick.com.

Claim:
The exercise of rights arising from liability for defects in the goods.

Handling of a Claim:
Conclusion of the claims procedure by repairing or replacing the goods, providing an appropriate discount on the purchase price, refunding the purchase price, or rejecting the claim with an explanation.
2. Liability for Defects

The Seller is liable for defects that the goods have at the time of delivery to the Buyer, as well as for defects that become apparent during the statutory period of liability for defects in accordance with applicable law.
For used or discounted goods, liability for defects is governed by applicable law and the information provided for the specific product.
The Seller is not liable for defects of which the Buyer was informed before entering into the purchase contract or which were taken into account in the price of the goods.
3. Specifics of Collectibles

For collectible items (such as comic books, trading cards, figurines, coins and similar items), the condition of the goods is always stated in the product description.
For graded products (CGC, PSA, BGS, etc.), the condition stated on the certificate issued by the relevant grading company is decisive.
For ungraded (raw) products, the condition is described to the best of the Seller's knowledge. Buyers are advised to carefully review the photographs and product description before entering into the purchase contract.
A claim cannot be successfully made solely on the grounds of subjective disagreement with the stated condition of the product if its condition is clearly shown in the photographs and described in the product description.
A slab is a special protective plastic case containing a certificate that protects the collectible item and confirms its authenticity and grading.
Damage to, opening, or tampering with the protective case (slab) caused by the Buyer does not constitute a defect in the goods and does not constitute grounds for accepting a claim.
4. Making a Claim

The Buyer is required to inspect the goods without undue delay after receiving them.
If the Buyer discovers visible damage to the shipment upon delivery, the Buyer is advised to refuse the shipment or have a damage report prepared with the carrier.
A claim may be submitted by e-mail to info@collectorpick.com or info@collectorpick.sk.
When submitting a claim, we recommend providing:
- order number,
- description of the defect,
- photographs showing the claimed defect,
- Buyer's contact details.
The Seller may request the Buyer to return the claimed goods for inspection.
The claimed goods should preferably be returned properly packaged together with proof of purchase or another document proving the conclusion of the purchase contract.
5. Handling of Claims

The Seller will acknowledge receipt of the claim without undue delay.
The claim will be handled no later than 30 days from the date it was submitted, unless applicable law provides for a different period.
The Buyer will be informed of the method of handling the claim by e-mail or another agreed method.
If the claim is accepted as justified, the Seller will arrange for the defect to be remedied, the goods to be replaced, an appropriate discount on the purchase price to be provided, or the purchase price to be refunded, in accordance with applicable law.
Funds will be refunded to the Buyer without undue delay after the justified claim has been resolved.
6. Cases Not Covered by Liability for Defects
Rights arising from liability for defects do not apply in particular to:
- normal wear and tear resulting from use,
- defects caused by improper use, storage, or maintenance,
- mechanical damage caused after the goods have been received by the Buyer,
- damage to or opening of the protective case (slab) caused by the Buyer,
- damage to the original factory seal of products (such as hobby boxes, booster boxes, booster packs, or other sealed collectible products), unless the defect already existed at the time the goods were received,
- defects of which the Buyer was informed before entering into the purchase contract,
- defects caused by unauthorized intervention or repair,
- damage caused by a natural disaster or other external circumstances.
7. Costs Related to Claims

The Buyer is responsible for the cost of returning the claimed goods to the Seller.
If the claim is accepted as justified, the Seller will reimburse the Buyer for reasonable costs of returning the claimed goods, generally up to the amount of the cheapest commonly available shipping method.
If the claim is not accepted as justified, the shipping costs will not be reimbursed to the Buyer.
8. Final Provisions

This Complaints and Claims Procedure enters into force on the date of its publication on the Seller's website.
The Seller reserves the right to amend or supplement this Complaints and Claims Procedure. Any new version of the Complaints and Claims Procedure enters into force on the date of its publication on the Seller's website.
This Complaints and Claims Procedure forms an integral part of the Terms and Conditions of CollectorPick s. r. o.
