Terms and Conditions of CollectorPick s. r. o.

1. Introductory Provisions

These Terms and Conditions govern the rights and obligations between:

These Terms and Conditions govern the relationship between the Seller and the Buyer who orders goods through the online store collectorpick.com.


2. User Account

The Buyer may purchase goods with or without registering an account.

When registering, the Buyer is required to provide true and up-to-date information and is obliged to update such information if it changes.

Access to the user account is protected by a password. The Buyer is obliged to protect their login credentials and not to disclose them to third parties.

The Seller reserves the right to cancel a user account in the event of a breach of these Terms and Conditions or prolonged inactivity.


3. Goods Offered for Sale

CollectorPick s. r. o. mainly offers:

  • comics (CGC-graded and ungraded/raw),
  • collectible trading cards (sports cards, Pokémon and others; graded and ungraded),
  • collectible figures (Funko Pop and others),
  • sports jerseys,
  • puzzles,
  • card games,
  • investment precious metals (mainly gold, silver and other precious metals),
  • other collectible and related goods.

4. Conclusion of the Purchase Contract

The presentation of goods on the website is for informational purposes only and does not constitute an offer to conclude a purchase contract.

The Buyer's order constitutes a proposal to conclude a purchase contract. The purchase contract is concluded upon confirmation of the order by the Seller.

The Seller reserves the right to request additional confirmation of an order, particularly for high-value orders.

The Buyer will be informed of the acceptance of the order by e-mail.


5. Product Prices and Payment Terms

Prices are stated including VAT and all statutory charges, except for shipping costs, which are stated separately.

Payment may be made by:

  • bank transfer,
  • GoPay payment gateway,
  • Stripe payment gateway,
  • cash on delivery (if available).

In the case of advance payment, the goods will be shipped only after the payment has been credited to the Seller's account.

The invoice will be sent electronically.


6. Delivery Terms

The goods are delivered by courier, through Packeta, or by postal service to the address or pick-up point specified by the Buyer.

The Buyer is obliged to check the condition of the shipment upon receipt.

If the shipment is visibly damaged, the Buyer does not have to accept it and is advised to notify the carrier of the damage without undue delay.

7. Withdrawal from the Contract

The Buyer – consumer has the right to withdraw from the contract without giving a reason within 14 days from the date of receipt of the goods, in accordance with applicable law.

The consumer is entitled to handle the goods only to the extent necessary to determine their characteristics, nature and functionality in a manner similar to how they would be allowed to examine the goods in a physical store.

If the consumer handles the goods beyond the extent necessary to determine their characteristics and functionality, and this results in a reduction in the value of the goods, the consumer shall be liable for such reduction in value.

Special Provision for Collectible Items in Protective (Slabbed) Packaging

A slab is a special protective plastic case containing a certificate that guarantees the condition and authenticity of the collectible item. More information can be found on the "What is a Slab?" page or in the FAQ section.

Opening, cracking, tampering with or otherwise damaging the protective case (slab) results in a significant reduction in the collectible value of the product. In some cases, this may result in the loss of a substantial part of the value or even the entire collectible value of the product.

Such damage constitutes handling beyond the extent necessary to examine the goods, and the Seller is entitled to reasonably reduce the amount refunded according to the extent of the reduction in the value of the goods.

Withdrawal from the contract is not possible for goods manufactured according to the customer's requirements or for other goods for which this is provided by law, such as collectible packs or products whose protective packaging has been opened or tampered with after delivery, where, due to their nature, they cannot be resold for hygiene or safety reasons.

When withdrawing from the contract, the Buyer shall bear the direct costs of returning the goods, including the costs of returning the goods from abroad.

The Seller shall refund the consumer's payments no later than 14 days from the date on which the notification of withdrawal from the contract is received, but not before the goods have been returned or the consumer has provided proof that the goods have been sent back.


8. Liability for Defects (Complaints)

The Seller is liable for defects that the goods have at the time of receipt, as well as for defects that become apparent during the statutory warranty period in accordance with applicable laws and regulations.

For collectible items, the condition of the goods is always stated in the product description.

For graded products (CGC, PSA, BGS, etc.), the condition stated on the certificate issued by the respective grading company shall be decisive.

For ungraded (raw) products, the condition is described to the best of the Seller's knowledge.

Defects or deficiencies cannot be claimed if the Buyer was informed of them before concluding the contract, if they were taken into account in the price, or if they were apparent from the photographs or product description.

The warranty does not cover normal wear and tear resulting from use or damage caused by the Buyer.

Warning Regarding Slabbed Products

Opening or damaging the protective plastic case (slab) constitutes a significant alteration of the collectible product. Such damage may substantially reduce its value, in some cases by up to 100%.

Damage to the slab caused by the Buyer does not constitute a manufacturing defect and is not grounds for accepting a complaint.

Warning Regarding Ungraded (Raw) Products

The Buyer is responsible for any damage caused after receipt of the product, in particular bending, creasing, tearing, edge damage, scratching, discoloration or other mechanical damage.

Even seemingly minor damage may significantly reduce the value of collectible products, in some cases by up to 100%, and such damage is not grounds for accepting a complaint.

Opened Packaging and Sealed Products

For products supplied in sealed packaging (for example, hobby boxes, retail boxes, booster boxes, booster packs, card game packaging or other sealed collectible products), interference with the goods includes in particular:

  • opening the packaging,
  • breaking the manufacturer's seal,
  • removing the protective film,
  • removing security stickers,
  • any other action that results in the original factory seal of the product being compromised.

Such actions substantially reduce the value of the product and also make it impossible to verify its completeness and original condition. Damage to or removal of the original factory seal carried out by the Buyer therefore does not constitute grounds for accepting a complaint or exercising rights arising from liability for defects, unless the defect existed at the time the goods were received.

We recommend submitting a complaint without undue delay after discovering the defect so that the defect can be properly assessed, but no later than 24 months from receipt of the goods.

The customer shall bear the cost of returning the goods for a complaint.

If the complaint is accepted as justified, the Seller shall reimburse the customer for reasonable costs of returning the goods, generally up to the amount of the cheapest commonly available shipping method.

If the complaint is not accepted as justified, shipping costs will not be reimbursed.

9. Personal Data Protection

The processing of personal data is governed by the separate Privacy Policy document published on the online store's website.


10. Alternative Dispute Resolution (ADR)

The consumer has the right to contact the Seller with a request for remedy if they are not satisfied with the manner in which a complaint has been handled or believe that the Seller has violated their rights.

If the Seller responds negatively to the request or fails to respond within 30 days, the consumer may submit a proposal to initiate alternative dispute resolution in accordance with Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes.

The consumer may also use the European Online Dispute Resolution (ODR) platform.


11. Final Provisions

These Terms and Conditions enter into force on the date of their publication on the Seller's website.

The Seller reserves the right to amend or supplement these Terms and Conditions. The new version of the Terms and Conditions shall enter into force on the date of its publication on the Seller's website.

Legal relationships not governed by these Terms and Conditions shall be governed by the applicable provisions of the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, and other generally binding legal regulations of the Slovak Republic.
